Terms and Conditions

By booking or participating in a tour and any related products or services (a “Tour”) with Machu Picchu by Traveleez, operated by Traveleez Peru SAC – RUC: 20612102849 (the “Travel Agency”), you (the “client”) agree to these Terms and Conditions (the “Terms”). These Terms govern your booking, participation, and interactions with all services provided by the Travel Agency. Unless otherwise stated, all monetary amounts referenced in these Terms are expressed in US Dollars (USD).

1. General Terms

All bookings made through the Travel Agency are subject to these Terms. By making a payment or participating in any activity, you confirm that you have read, understood, and accepted all conditions stated herein.

The Travel Agency reserves the right to update or modify these Terms at any time without prior notice. The version published on our website at the time of booking will apply to your reservation.

2. Booking

Your booking is confirmed, and a binding contract exists once the Travel Agency or your travel agent issues a written confirmation after receiving the applicable deposit amount.

Please review your confirmation carefully and report any incorrect or incomplete information immediately. All names must match exactly as they appear on the corresponding passport.

A non-refundable deposit is required to secure your booking. All deposits are strictly non-refundable under any circumstances.

You must present the original passport used at the time of booking to access the Inca Trail or Machu Picchu. If you have renewed your passport, you must bring both the old and new ones.

Only a valid University Student ID with an expiration date within the same year as the trek will be accepted for student discounts, in accordance with Peruvian government regulations. A copy must be provided at the time of booking.

It is the client’s sole responsibility to provide accurate and complete contact information (email address and mobile/WhatsApp number) at the time of booking. The Travel Agency will send tickets, vouchers, and travel documents to the contact details provided by the client at the time of booking.

If the client does not receive these documents within 72 hours before the start of the tour, it is the client’s responsibility to contact the Travel Agency immediately through the contact channels available on our website (contact form, email, WhatsApp) to request resending. These channels are available at all times prior to departure.

The Travel Agency is not responsible for non-delivery of documents resulting from incorrect, incomplete, or outdated contact information provided by the client, for documents filtered into spam/junk folders, or for the client’s failure to use the available contact channels to follow up. Proof of dispatch retained by the Travel Agency (timestamped delivery records) shall be considered sufficient evidence of compliance with this obligation.

Travelers under 18 years of age must be accompanied by a parent or legal guardian, or present written and notarized authorization from a parent or legal guardian to travel, in accordance with Peruvian regulations for minors.

3. Machu Picchu Tickets

Tickets to Machu Picchu are issued under the traveler’s personal details and are non-refundable, non-transferable, and non-changeable under any circumstances.

Once purchased, tickets cannot be modified to change the traveler’s name, date, or route. This is a strict policy of the Ministry of Culture of Peru, the sole authority that manages access to the Machu Picchu Sanctuary.

In rare or exceptional cases, such as closures, rescheduling, or force majeure events officially declared by the Ministry of Culture, modifications or refunds may be considered according to official governmental regulations. The occurrence of such an event does not by itself guarantee that a refund or change will be authorized; this determination is made exclusively and at the sole discretion of the Ministry of Culture of Peru on a case-by-case basis.

The Travel Agency will assist in managing any such process, but final approval lies exclusively with the Ministry of Culture of Peru. When authorized, refund processing by the Ministry can take four (4) months or longer, and the Travel Agency has no control over, and bears no liability for, these timelines.

By purchasing tickets through the Travel Agency, you acknowledge and accept these conditions as final and binding.

4. Cancellations

All deposits and tour balances are non-refundable, as the Travel Agency incurs non-refundable costs with local suppliers (transport, permits, accommodation, staff) immediately upon confirming your booking. This applies regardless of the reason for cancellation, including medical emergencies, except where mandatorily required otherwise by applicable Peruvian consumer protection law.

If you need to cancel, additional costs may apply depending on how close to the start date the cancellation occurs, as detailed below. All amounts are expressed as a percentage of the total tour cost, in USD.

Permits for the Inca Trail are personal, non-transferable, and cannot be changed once issued. This policy is mandated by the Peruvian government and not by the Travel Agency.

5. Medical Information

Clients must disclose any medical conditions, allergies, or relevant health issues to the Travel Agency before booking.

Participants should be in good physical condition. Travelers over 70 years of age must present a recent medical certificate confirming they are fit for travel.

Pregnancy must be disclosed at the time of booking. The Travel Agency reserves the right to refuse participation to travelers over 24 weeks pregnant or to anyone deemed unfit for the physical demands of the tour, based on the physical requirements of the specific itinerary.

The Travel Agency strongly recommends all participants purchase comprehensive travel insurance covering medical emergencies, evacuation, trip interruption, and personal loss. The Travel Agency does not provide medical advice.

6. Tours and Treks

All outstanding balances must be paid before the pre-tour briefing (usually held the night before departure).

Accepted payment methods:

  • Cash
  • Visa debit/credit card (~5% service fee)
  • PayPal (~7% service fee)

If you choose to leave the group or campsite for personal reasons, you must inform your guide. Any issues during the tour must be reported immediately so that they can be addressed in real time.

If illness or injury prevents you from continuing, assistance will be provided to reach an emergency point. Any medical, evacuation, or transportation costs are the client’s responsibility.

If you cannot complete the trek, the Travel Agency will help coordinate meeting your group at Machu Picchu, but no refunds will be issued.

The Travel Agency is not liable for weather conditions, strikes, natural disasters, illness, injury, or loss of personal items. Clients must carry appropriate insurance to cover these situations.

We reserve the right to modify itineraries or cancel tours due to unforeseen circumstances to ensure safety and service continuity.

Group tours may include up to 16 participants. By joining, you acknowledge that pace, timing, and dynamics may vary among participants.

7. Liability

The Travel Agency employs qualified staff and takes reasonable care to ensure safety and service quality. However, the Agency is not responsible for acts, negligence, or omissions by third parties.

Clients are fully responsible for their personal belongings, equipment, and conduct during the tour.

8. Travel Insurance

Travel insurance is strongly recommended for all travelers and remains the sole responsibility of the client.

It should cover cancellations, accidents, illness, repatriation, and personal belongings. The Travel Agency bears no responsibility for any costs resulting from incidents not covered by the traveler’s insurance.

9. Force Majeure and Unforeseen Circumstances

The Travel Agency shall not be held liable for any failure or delay in performance due to circumstances beyond its control, including but not limited to natural disasters, strikes, social unrest, governmental decisions, epidemics, or transport disruptions (“Force Majeure”).

In such events, itineraries may be altered, postponed, or canceled. Refunds or credits, if applicable, will depend on policies established by suppliers or Peruvian authorities.

10. Modifications by the Client

Any modification request (change of name, date, or service) must be submitted in writing and is subject to approval and availability. Administrative fees may apply.

Once tickets or permits (e.g., Machu Picchu or Inca Trail) have been issued, no modifications are possible under any circumstances, except in the extraordinary cases described in Section 3 above, which are subject exclusively to the discretion and criteria of the Ministry of Culture of Peru — not the Travel Agency. The Travel Agency does not determine eligibility for such exceptions and cannot expedite the Ministry’s review or refund timelines.

11. Photography and Media

During tours, staff or guides may take photos or videos for promotional purposes. By joining, you grant permission for the use of such images by the Travel Agency for marketing or social media, unless you explicitly opt out in writing before the start of the tour by notifying the Travel Agency through the contact form or email address published on our website.

12. Privacy and Data Protection

The Travel Agency collects and processes personal information solely for booking, payment, and operational purposes.

Your information will not be shared with third parties except as required by law or to fulfill travel arrangements (e.g., hotels, transportation providers).

By booking, you consent to the processing of your data in compliance with Peruvian Law N° 29733 – Personal Data Protection Law.

13. Complaints and Claims

Any complaint regarding tour services must be submitted in writing within 7 calendar days after the tour ends. See claims book.

The Travel Agency will review and respond within a reasonable time frame. Clients may also register formal complaints in the official MINCETUR “Libro de Reclamaciones,” available upon request.

14. Client Responsibility

Clients are expected to act responsibly, follow the guide’s instructions, and respect local laws, culture, and the environment.

The Travel Agency reserves the right to remove any participant from a tour without refund in cases of misconduct, unsafe behavior, or actions that endanger others or the environment.

15. Acceptance of Terms

By booking any Tour, Ticket, or related service with the Travel Agency, you confirm that you have read, understood, and accepted these Terms and Conditions.

This agreement is legally binding and governed by Peruvian law.

16. Legal Information

Machu Picchu by Traveleez and Machu-Picchu.org are operated by Traveleez Peru SAC, a legally registered travel and tourism company in Peru under RUC: 20612102849.

All legal matters shall be governed by and interpreted in accordance with the laws of Cusco, Peru, and any disputes shall be resolved in the courts of Cusco.
